On April 14,
2005, the Nutraceutical Corporation - the creators of the original MetaboLife
weight loss supplement - won a landmark case in which a federal judge overturned
the FDA's 1994 ban on Ephedra based products.
Utah federal district judge Tena Campbell
ruled in favor of Nutraceuticals, stating that the FDA did not have the
authority to regulate a dietary supplement and more importantly, had failed
to prove that a 10mg dose of Ephedra posed any sufficient health risk.
Thanks to the ruling, Ma Huang Ephedra is once again legal and available
on the market.
